By using QuickVisitMD you agree to these Terms of Service. If you do not agree, do not submit a request or use the service.
Terms of Service
These Terms describe what the service is, what it is not, how payment and refunds work, and how disputes are handled.

These Terms form a binding agreement between you and Ankur Sunildatta Fadia PLLC d/b/a QuickVisitMD. Please read carefully, including the arbitration clause and the limitation of liability.
By using QuickVisitMD you agree to these Terms of Service. If you do not agree, do not submit a request or use the service.
QuickVisitMD is operated by Ankur Sunildatta Fadia PLLC d/b/a QuickVisitMD. The service provides asynchronous, physician-reviewed evaluation and treatment for selected low-acuity adult concerns. You acknowledge and agree that:
You understand that QuickVisitMD is primarily an asynchronous secure-message service. There is no live video visit or in-person examination. For patients physically located in West Virginia, a brief real-time physician audio call is included as part of the encounter as required by state law. Compared to in-person care, telemedicine has inherent limitations, including:
You accept these limitations and the associated risks in exchange for the convenience of asynchronous care.
Payment does not guarantee treatment, medication, or a prescription. The physician may ask follow-up questions, recommend in-person care, or decline the request when online treatment is not appropriate.

QuickVisitMD may use artificial intelligence (AI) and automated tools to assist with intake processing, documentation drafting, and translation. You acknowledge and agree that:
You select a response window at checkout. The guaranteed response window runs during posted service hours: daily, 6:00 AM-9:00 PM ET. For QuickVisitMD, weekend hours within that posted schedule count as posted service hours. Standard is within 8 posted service hours, Priority is within 4 posted service hours, and Rush is within 1 posted service hour.
QuickVisitMD is a self-pay practice and does not accept or bill insurance. As required by the No Surprises Act (Public Law 116-260, Division BB, Title I), uninsured or self-pay patients have the right to receive a Good Faith Estimate of expected charges before receiving care. QuickVisitMD displays its fixed pricing on the pricing page and at checkout. A written Good Faith Estimate is generated at checkout before payment and is available for download through the secure patient portal. If you are billed for more than the Good Faith Estimate, you may dispute the bill. For questions or disputes, call 1-800-985-3059 or contact admin@quickvisitmd.com or visit cms.gov/nosurprises.
QuickVisitMD does not participate in, accept assignment from, or bill Medicare, Medicaid, TRICARE, or any other government or commercial health insurance program. The physician is not enrolled as a provider in any government or private insurance network for services delivered through this platform.
No superbills, CMS-1500 claim forms, or insurance-ready documentation will be provided. You agree not to submit any QuickVisitMD receipt, invoice, Good Faith Estimate, or documentation to any government healthcare program or private insurance plan for reimbursement. Any attempt to do so is solely your responsibility and QuickVisitMD bears no liability for denied claims, audits, or other consequences.
If you are enrolled in Medicare, Medicaid, or another government healthcare program, you understand that using QuickVisitMD is a private-pay arrangement that is separate from and outside of your government benefits, and that your government program will not reimburse you for services obtained through this platform.
The physician providing care through QuickVisitMD owes the same duty to exercise reasonable care, diligence, and skill as would apply to an in-person encounter, consistent with the accepted standard of care in Virginia and West Virginia. The asynchronous delivery modality does not reduce the physician's professional obligations.
Your intake answers, messages, photographs, clinical documentation, and after-visit summary are maintained as part of your medical record. QuickVisitMD retains adult medical records for a minimum of 10 years, which exceeds both Virginia's minimum retention period (6 years) and West Virginia's minimum retention period.
You may request a copy of your medical record at any time through the medical records request page, through the secure patient portal, or by emailing admin@quickvisitmd.com. Requests are processed within 30 days as part of our records access commitment. There is no fee for electronic copies of your records.
You agree to provide accurate information, including identity, current location, and health information relevant to the request. You are responsible for keeping your portal credentials confidential. Misrepresentation may result in cancellation of the request without refund and termination of your account.
You may close your account at any time by emailing admin@quickvisitmd.com. We may suspend or terminate your account with reasonable notice for abuse, misrepresentation, non-payment, or misuse of the service, and immediately for conduct that threatens the safety or integrity of the service. Termination does not relieve either party of obligations that by their nature survive, including record retention, payment for services rendered, and limitations of liability.
The QuickVisitMD name, logo, site content, and software are owned by QuickVisitMD and its licensors. You may not copy, modify, or redistribute site content except as permitted by law.
The service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure against every risk.
To the fullest extent permitted by law, in no event shall QuickVisitMD, its physicians, officers, employees, contractors, or affiliates be liable for indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or related to the service. For claims relating to the platform, website, software, billing, or non-clinical aspects of the service, the aggregate liability of QuickVisitMD is capped at the total fees you paid to QuickVisitMD in the 12 months preceding the event giving rise to the claim.
Professional negligence carve-out. Nothing in these Terms is intended to limit or waive any rights or remedies you may have under Virginia or West Virginia law for claims of professional medical negligence (medical malpractice). Such claims are governed by the applicable state medical malpractice statutes, including any caps, procedures, or panels established by law, and are not subject to the aggregate liability cap stated above.
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles.
Subject to the arbitration clause below, you agree that any action or proceeding arising out of these Terms shall be brought exclusively in the state or federal courts located in Virginia, and you consent to personal jurisdiction and venue in those courts.
Any dispute, claim, or controversy between you and QuickVisitMD arising out of or relating to the service or these Terms — except claims of professional medical negligence (medical malpractice), which are governed by applicable state law and any required pre-suit procedures — shall be resolved by binding individual arbitration administered by a nationally recognized arbitration provider under its consumer rules, seated in Virginia. You and we waive any right to a jury trial and to participate in a class, collective, or representative proceeding for arbitrable claims. This clause does not prevent either party from seeking small-claims relief or injunctive relief for intellectual-property misuse.
Opt-out. You may opt out of binding arbitration by emailing admin@quickvisitmd.com with the subject line "Arbitration Opt-Out" within 30 days of first creating your account or first agreeing to these Terms, whichever is earlier.
We may update these Terms from time to time. Material changes will be announced with at least 14 days' advance notice by posting the revised Terms on this page and updating the effective date. Your continued use of the service after the effective date constitutes acceptance of the revised Terms.

You agree to indemnify, defend, and hold harmless QuickVisitMD, its physician, officers, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from: (a) your breach of these terms;(b) your use of the service for unlawful purposes; (c) your violation of any third-party right; or (d) any information you provide that is false, misleading, or inaccurate.
This indemnification does not apply to, and you are not required to indemnify any party for, claims arising from the physician's own professional medical negligence or willful misconduct.
We are not liable for any failure or delay in performing our obligations under these terms due to events beyond our reasonable control, including but not limited to natural disasters, acts of war or terrorism, governmental action, cyberattacks, power outages, pandemics, or internet service disruptions, provided we resume performance as soon as reasonably feasible after the event subsides.
If any provision of these terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction or arbitrator, that provision shall be severed or modified to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
We may assign our rights and obligations under these terms to any successor, acquirer, or affiliate without prior notice to you. You may not assign or transfer your rights or obligations under these terms without our prior written consent.
By using QuickVisitMD and checking the consent boxes during intake, you consent to transact business electronically, in accordance with the federal Electronic Signatures in Global and National Commerce Act (E-SIGN Act, 15 U.S.C. § 7001 et seq.) and the Virginia Uniform Electronic Transactions Act (Va. Code § 59.1-479 et seq.). Specifically:
The failure of QuickVisitMD to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by QuickVisitMD. No single or partial exercise of any right or remedy shall preclude further exercise of that or any other right or remedy.
The section headings in these Terms are for convenience only and have no legal or contractual effect.
These terms, together with the Privacy & Confidentiality Notice, Telehealth Informed Consent, and Accessibility Statement, constitute the entire agreement between you and QuickVisitMD regarding your use of the service. All prior or contemporaneous negotiations, representations, warranties, and understandings are superseded.
